Legal Question in Family Law in India
I have my cousin who was married at the age of 17 years. My cousin's husband stayed with her only for nearly 3 years after that my cousion's husband left her and shifted to another city and never turned back. during the stay my cousin also gave birth to a son who is stayin with my cousion only and she is taking care of the son for everything.
Now its been more than 8-9 years my cousin is living along with her son and her husband never contacted her and now after such a long time of seperation, my cousin also doesnt want to contact her and want to get legal separation to move forward in life as she wants the second marriage.
Kindly advise as since its been 8-9 years and also there is no contact details of her husband available with my cousion can she move forward and do the second marriage. As for legal divorce, there has to be some contact details.
Her parents in law also died in a road accident 2 years back.
Thanks

Your cousin can file missing report about her husband before the police stating that he has been missing since 9 years and once the police give her the status report of the case. She can re-marry without filing any divorce petition by taking any of the grounds mentioned in the act. ........................................Please check Sanjay Kalra and Associates on the internet to know more about our law firm and the legal services we are rendering for our clients from all over the World.
