can custody for the minor child be filed as an Interim application in the maintaence petition filed by the opposite party

Yes an application for custody as an interim arrangement can be filed during pending proceedings under Hindu Marriage Act.

No,it can not be filed as it would be beyond jurisdiction.File custody case.

there is no boundation for filing of application but the custody will be given to the person who can better handle the child. in normal circumstaces the mother may get it.
