Legal Question in Family Law in India

Custody of Minor Daughters - Part 3

My lawyers not bothered to read everything. I have a straight forward case. I dont have the right to deprive the children of their mothers love and will do everything to promote a healthy relationship between them. I am never going to take them away from her. But the children need their father also. It is their right. I am only asking for access so that they may benefit and enjoy their fathers love and support. They are very attached to me. Have submitted photos as evidence. Have created their own room in my new apt with everything they need...bunk bed, study tables, toys, teddy bears, dressing table carpets, blankets, towels, wardrobe...everything. Have submitted these photos also as evidence. Now - Even if the court passes a favourable order, what is the guarantee that she will obey them. I have stopped payments because she does not have the money even from their school. One emergency and she will be on the road. I have repeatedly told the court that I am willing to pay everything and more. I am hoping that when she asks me for money for the children, I will lay down my conditions which will be - complete access to the children and day care while she is in office. Am I doing the right thing? I am so sad/confused. Please advice.

Re: Custody of Minor Daughters - Part 3

If you are not satisfied with your lawyers, you may consider changing them and engage another lawyer. However, your action in stopping payments may go against you. therefore, you should never stop payments unless the court has permitted you to do so. You are not right in thinking that you may impose conditions when money is demanded.

You may better follow the court order; and seek modification of the order if you are not satisfied with the arrangement;

You may challenge the order in the next higher court also if you have sufficient grounds available.
