My dad remarried before one year and he died after one year and three months me and my brother do not want to live with our step mother and father had not made any will what we can do?

You can seek partition of his estate, all of you, including your step mother; is entitled to one share each.

your step mother is entitled to 1/3 share in the proeprty of your father. now you have to seek partition
