can my daughter claim property
my daughter is 4 years old..my husband has deserted me since the conception of the child..he is entitled to pay us monthly maintaenace but can we claim property which in not in husbands name but in his fathers name and grandfathers name

as per the latest amendment in HIndu Succession Act, a daughter is also entitled to call for partition and she hold equal share. she may claim the property and at the same time, u may seek ur reliefs under DVact and other options available for u.

During the life time of your husband's father and grandfathers, the child will ONLY have claim towards maintenance against your husband. The issue of inheritance in ancestral property may not arise at this stage.
