Dear all,it is my sister-brother inlaw case, going in kanpur courts. my sister has applied restitution of conjugal rights section-9. after serving summons, my brother-in-law's lawyer once attended the courts, almost 70 days back. till date, almost 4-5 hearings already are already over, but they neither file WS nor my brother-in-law appears in courts. for how many months, will all this repeat?

you may ask your lawyer to plead for striking off the defense of opposite party who failed to file WS within stipulated time.
It seems your BIL is not interested to contest the matter and therefore not appearing or filing his WS etc. . Even if your sister get a decree of Restitution from the court but sill cant force her husband to stay with her. This may become a ground for her to get Divorce from her husband.
