Dear Experts,

Kindly advise on the following.

An Indian citizen got married to a foreign national in her country itself according to the laws prevailing there. Now the guy is living in India seprate from his wife. She does not want to come to India and stay with her Indian husband.

The Husband in India wants to file divorce case in India. What is the procedure and what needs to be keep in mind for such divorce?

the husband can file the divorce and summons would be sent to the foreign national in her country. in case she does not appear despite receiving summons, the divorce would be granted ex parte.
