Legal Question in Family Law in India

Dear Rajiv Sir,

To my previous question in the forum, you suggested that domestic violence case has time limit of 60 days. My husband is in US on a project. He works with a Indian company but will be on project in US for about a year. If I file a domestic violence case in India and if the court passes orders for providing me house and maintainence, how can we ensure that he obeys the orders. Since he is in US I think he wont even come for court hearings. What will happen if he does not come for court hearings or if he does not give maintainence and house on court orders. Do you think it is pratical to file a domestic violence case? Please advice.

even if your husband is in US, he will be served the summons through Ministry of External Affairs or the related department and he would be given a chance to defend his case. in case he does not defend himself, an exparte order would be pronounced and you can execute this order through the same department and as Domestic Violence is also an offence in US, things would be easier for you. where do u intend to file the case?"
