Legal Question in Family Law in India
Dear Sir(s),
Against my earlier quarry regarding transfer of civil suit filed by mother-in-law of the girl (after diverse order of the court at girl's native place) regarding theft of golden ornaments belonging to mother-in-law, the law guru team had very wisely consoled that the case could be transferred to girl's parental place by the High Court; the case has since been transferred and the High Court had directed both the parties to appear before the court on 14th.Jan.2010 but the complainant did not appear and they have been sent a notice by the court to appear on the next hearing.Meanwhile the complainant has approached the police authorities at parental place of the girl regarding the above said theft of gold which had never occured. If it had, the complainant should have asked at the time of settlement of the alimony for past preent and future to the girl. The complainant, the mother-in-law of the girl had signed the compromise before filing the petition by mutual consent.Earlier too, after the diverse order; she had papproached the local police at her place alledging the golden jewlary but on submission of the copes of compromise, the diverse order etc. the complaint was filed by the police. Thereafter the above civil case.
The complainant(s) are influential persons( the father-in-law of the girl is working in the office of a well known minister's office) and they have brought forward the mother of the boy(keeping aside the boy and the father. The boy is in Govt.service on contract so they did not want to bring him in the picture. They want to ruin the future of the girl and un-necessarily harrass the parents of the girl also. There is every possibility that they can also harm the girl at her work place.
I request to kindly guide what should we do

in case she has received some amount during the first motion of divorce or at the time of putting her signatures on divorce on mutual consent, she may not back out. you may approach the court for appropriate remedy.
