Legal Question in Family Law in India

Dear Sir,

I had been married at 2003 as and after few year we go to another city for job now in that city living standard is too high, due to that it is not easy to survive, and due to this our married life and also we don't have sexual relation due to this, so i taken decision that we should go back to own city.i have that much enough income to survive their with better education for child. she and her family decided that if you want to go back you can go but she will not come to you and your home, if you want to live together you should live in new city, we are separate from last one year, can it be a ground for Divorce. i am ready to live with her but not in new city due to my low income.

Please guide me.....

try to sort this matter as you also have a child. try to convince her to stay with you for the sake of the child. you may seek help of elders in family. there seems to be communication gap between you too. you may visit www.karvai.in for further guidance.

Sir, it is better you go back to your city where you can survive and thereafter try to convince her and bring her back and if she refuses issue a legal notice to join you if she refused file a suit for restitution of conjugal rights or you can file a suit for divorce on ground of desertion.
