Legal Question in Family Law in India

Dear Sir,

I have got Stay for arrest for 498A case from Allahabad High court and the case is referred to

mediation. If charge sheet is filed by police. Then please suggest what should I do ? Do I try to

get bail from Allahabad High court ? or Should I first see what result comes from mediation

and then try to get bail.

One more question If I get same day bail from Allahabad high court and stay order of arrest still

exists then can I get bail from lower court without being arrested ?

take active part in mediation and get everything recorded as far as possible. though it may not be used in judicial proceedings. never say no to anything and if u dont want to do then show some constraint.

in the form of stay you have received the mandate from the court which you should use sensibly and dont go for bail etc till the stay order is active. if you have not given back the stridhan of the girl then give letter to the authority or the girl to take away her stridhan which is lying as she left it. etc its better to consult a local lawyer.

Once charge sheet is filed in court, you may need to seek bail from the court concerned.
