Legal Question in Family Law in India
Dear Sir,
I am been thrown out of my matrimonial house by force. I files both 498a and Domestic violence case aginst by husband and in laws. IN DVC i have asked for relief under all section except child maintaince (we dont have child). However, magistrate is dragging the case unncessaruly. It si been mpre than 2 months i filed DVC. Till date i was not even given right to reside in my shared house.
My husband accepted before magistrate that he dont want to take me back in to his house. Now he is not emplyed any where. So my q is that i cannot aask for alternate accomodation, neither he is nt ready to take me back.
Now my q is there any way that i get right to live in my shared house hold i mean through human rights commission like that. if i get what would be validity of the order.

you have a right to reside in the shared household in case the husband is also staying there. in case the husband is outside or staying on a rented accommodation, you have a right to reside in that accommodation itself.
Font worry. Judicial process takes some time due to large no of pendency. But in any case ur right of residence will be granted. On next date of hearing emphasise on ur irony before d court.
