Legal Question in Family Law in India

Dear sir,

Recently i have filed RCR against my wife to come back and live with me

But they are seeking only for Divorce my question is

1. whether can i give mutual consent for divorce while have applied for RCR

2. If they agreed , should i need to pay any maintenance to my wife and my child.

Please clarify....

am so depressed as i sent wedding day gift through courier but they have refused to take it and returned back

You have to withdraw your RCR from the court to have Mutual Consent divorce . All the settlement which is mutually agreeable by you and your wife would be mentioned in your mutual divorce petition. If you do not agree with something you can refuse to sigh the petition.
