Legal Question in Family Law in India

Need Help

Dear Sirs,

We have a huge property which my father and grandfather helped in the making, its a theatre in the city.

My Father has(including him) 4 brothers and 2 sisters. Two sisters have been divorced long time back and one stays in the family and the one who had a love marriage does not stay in the family. My grandfather passed away in 1996. The theatre property is in the name of my grandfather and his sons.

The house is in the name of my grandmother who is now mentally and physically challenged.

My questions:

1) For a will to be documented and signed , do you need signatures or all the family members?

2.) Do the daughers have the right to challenge the theatre property?

3.) Is the grandmother entitled to anything?

4.) Does my father who is staying in his mother' place have any right on the house for his portion, bez he is dwelled there for 60 years?

Can you suggest some very good lawyers in HYDERABAD, how long would legal filings if any take to resolve in these matters.

well sorry i cant suggest you lawyers list from hyderabad but as far your case is concerned the estate/property left by your grand parents will be shared equally among the legal heirs and her widow.

i advice you to take legal steps at the earliest

A will is a personal document and is to be signed only by the executor of the will, and attested by any three witnesses (not necessarily relatives), one of whom, preferably, should be a doctor.

Yes, daughters also have a claim in the property

Yes, grand mother is also entitled to an equal share along with other heirs.

Father may have a share in the grand mother' property; however, staying there is irrelavnt.

2. Yes.Equal Right in all properties of their father.

3. Yes.Equal share as of other heirs.

4. No.As long mother is alive and after her,if she does not leave any will, then he shall be entitled to inherit equal share along with other legal heirs.

The estate of grandfather will go in equal share to his widow,sons and daughters.

The document i.e. Will is to be signed by the executor only and witnessth by any two persons may relatives or near or dearer.

Possession does not confer any ownership right.

There is no time limit but it desireable to take the legal steps at the earlist
