Legal Question in Family Law in India

DearSir/Ma'am,

Last year I took your opinion about my marriage i was newly married at that time and i asked that my husband was so aggressive and shouts on me badly without no reason and if i ask him the things for which he is suppose to answarable to me but he won't and instead of telling me he would shout on me and torture me like anything wherever I am and would insult me,now I am scared of him and feel myself disturb all the time.we completed one year of marriage and he is still like that, also i became to know that he was too friendly with one of his lady couligue in office, they would talk a lot and later i knew that they went outside office together few times in my husband's car when i asked him he again warned me that he'll lose his temper if i ask him all this and said his boss told him.i knew that it was not official but i am even not able to talk to him about it due to his behaviour.i feel my self humiltated and suffocated and cheated, what should i do now?we have completed one year of marriage in may'12.also i noticed that my husband has fetish for women he flirts in front of me many times and doesnt even leave my friends and cousins and keeps a bad eye on them but i cant say anything as i tried and said initially and he would do anything to keep me down and keep me my mouth shut so I am so scared if i object he'll torture me.once he tortured me for whole night,he took my clothes and other things and threw them and ask me to leave his house in night and said otherwise he will call to my family and ask them to come and pick me i was so scared of family about knowing all this which is happenning to me that i suffered all this quietly but now I am not able to bear anymore and there is a change in myself I really feel myself disturb all the time and it is ruining my life completly as I am so stuck up mentally i have become good for nothing.i know i cant have a life with him,can you suggest how to get rid of him?i dont want anything from them no jewellery no other things i'll just take my stuff back.i have no proof of him cheating on me and torturing me..how should I go ahead?would court ask for proofs?how much time it generally takes for a divorce?

also there is one more thing, his parents have lots of issue between them his father treated her mother as he is doing with me now because of that my mother in law had become mad and was traeted in a mental hospital now she's is okay but sometimes she becomes violent and behaves badly with others and shouts, she behaves very badly with me many times.most of the time taunting on me,she's so conservative but I am working and have no much time for house work so she taunts me manytimes and most of time in front of outsiders.she doesnt want that me and my husband go outside so my husband doesnt take me outside and he has all concentration on his mother and her behaviour all the time that he gave no time to me and says that he cant stay away from his parents, now I am completly lost and shattered please help me and advice can it be also a reason used for divorce?

Dear information seeker,

Provisions of law as prevailing in India viz, Hindu Marriage Act, DV Act, IPC etc., gives enough and ample protection and relief to a woman. At this stage, you can very conveniently drag your husband and in-laws to courts for considerable period of time and make them bow down to your needs/demand.

You just consult an advocate handling matrimonial matters & he/she will take care of the rest.

Remember, under the matrimonial laws the position of woman is advantageous as against a male.
