divorce and 498A

Relationships have gone sour. If I suspect there will be a 498a filed against me (falsely), and I dont intend to be in marriage, can I file for divorce before she thinks of 498A so as to enable me and my parents escape the harrowing experience of the law. Our marriage is under the Christian Marriage Act

498-A could be filed at any stage. Even you file a divorce first. But within seven years of your marriage.

Your filing of divorce may not protect you from 498-A case if she decides to initiate criminal proceedings against you for the cruelty suffered by her in marriage.

You may consider an out of court amicable settlement of the dispute.
