Re: about divorce because of adultry
do you have any proof that she is living in adultry. in case you have, you would be able to avoid maintenance to her but the right of child would still stand. you cannot avoid maintaining your child in any circumstances whatsoever.
Re: about divorce because of adultry
Fist Refuse to pay even a single panny.
Then try to findout both of them togehter and caught them red handed to the police. Else it is your duty to prove by any means that she is living in adultry none else can prove it.

Re: about divorce because of adultry
just a blame of adulty cannnot exempt u frm maintainence towards ur wife and child.... u ll have to prove her betrayal if u fail it wll b treated ur cruelty towards her and u may be accused for that offend.
better u gather proofs against her in perfect that will help u not only in free of maintainance but also to secure the custody of ur child.. but first thing that i would suggest is have a mutual matured conversation and try to bring her back and solve the problems that made hher be disloyal. coz its not about u and ur wife its about the future of your female child. true efforts never fail.

diffucult to prove adulterry unless u have relevant proof to satisfy the court if she is not working and have a child she may claim maintenence for more log on to www.angelfire.com/folk/indianlaws or log on to [email protected]
Re: about divorce because of adultry
She may be entitled to maintenance. The child custody may be decided by the court depending upon several factors. You may need to provide evidence about adultry and support your allegation. A bald allegation of adultry may constitute an offence of 'cruelty' by you against your wife for which she may initiate your criminal prosecution.
