Legal Question in Family Law in India
Regarding divorce
Hi,
I am from Bangalore India. I got married at 20/Feb/2007. it was arranged marriage. Actually, she had affair with some other person but because of family pressure she married with me but no one was aware of that. She stayed with me one month and then went back for her exam during that period her behavior was not like wife. She came Bangalore on 29th/August/2007, and on 12th/sepetember/2007 she left my house without any information so we filed a FIR of missing. But later we found she has gone with her friend (to whom she loves). We know that person name and address. Still we dont know where they are.
So please tell me how can get divorce soon? I spoke with my father in law, he said go ahead for divorce he will help me to get that. So please suggest me way so that I can get divorce easily and soon. I mean it should not take longer time.
Regards,
umesh

Re: Regarding divorce
You may seek divorce on the ground of your spouse having physical relationship with another man before and after marriage. Since the last known address is that of her father; and since her father has promised you help, you may get ex parte divorce on 2nd or 3rd date that may be fixed by the court.
Re: Regarding divorce
Since your wife has got physical relationship with an another man after marriage you can always file a petition on the grounds of cruely and mental harrasment.
If the wife is not present at the address then you can always get a 2 nd or 3rd party order of divorce from the court.
