Divorce is not that simple & easy as far you have stated your query.

As far Hindu Marriage is concerned it takes 18 months for the sepration.

I would advise you to go for a mutual consent divorce.

(a) If you do not live together for more than one year, you may file a "mutual consent" divorce petition u/s 13 (B) of Hindu Marriage Act.

(b) If you file a petition with allegations against your spouse who may contest the same, it may take long time for the court to adjudicate the issue. In that situation, you may or may not get divorce.

You can file the divorce after the period of dessertion is over but if you prove the cruelty you may file after one year. You may file the nullity of marriage but before doing so you have to consult with me or a lawyer.
