Legal Question in Family Law in India

My divorce case has been dismissed due to 18 months getting over. this happened on Dec 12 2012. It was mutual and we appeared one day late in the court. I'm confused now my lawyer is saying we can still apply same case with condonation letter and a solid reason for the delay. I want to know whether this will work or i need to apply for fresh case?
