Divorce by Mutul understanding

Hi

we are married one year back and we founded that we cannot live together anymore . We both are working in IT industry . At last decided we will live seperately for 6 months Can we get the divorce from court after we file application for it . Do we need to live seperately for more time after filing in court . What will be procedure can u guide further .

You will get divorce within six months only and you have to apper twice only.

minimum period for separation is one year under the HIndu Marriage Act if you want to file the divorce pettion by way of mutual consent. so you have to wait for six more months

After filing a mutual consent divorce petition, the court may record statement of both of you and fix a date for disposal of the petition six months later than the first hearing; On the second hearing after six months, the court may again record statement of both the parties to confirm their willingness and may dissolve the marriage.
