Mutual consent Divorce is when both parties present the petition together before the court for Divorce. But when one party is there and the other party is not there or not willing to sigh or ready to contest the same, in that eventuality the petition for Divorce becomes a contesting Divorce by taking one or more grounds mentioned in the act .There is no false identity. If you are married in India then you are married under indian laws and suppose to get divorce under the same laws or else your spouse or the other party can challenge the same before Indian courts or foreign court. Then the Decree of foreign court becomes null and void .
