Legal Question in Family Law in India
Divorce
I have previously asked a question ''seeking divorce coz of sexual affairs of my husband''. I got the rplies from the attornies. I also want to know if it is a big crime to take ''Thali (Mangalsutra)'' out, which i kept in one of my jeans in my ward robe which he eventually found out when he searched my cloths in suspision when i went to my parents and in my absence. I want to know if taking out thali is a crime as per law. I also want to Know as per his claim he says that Iam always moody and i never ever let him touch me or I never look at him (I did this becoz its such an awkward feeling for me to know that he already has many sexual affairs, and he still says he will not change and ive to adjust to his behaviour. i feel so bad even to have a look at him. But I never neglected him in providing food or any other needs of him on time.). Are these crimes? He never gave me enough money to run the house.

Re: Divorce
Ok,removing mangalsutra isn't a crime at al,so what is your doubt and hesitation you want to live with him forever living life in the same way or you want to seek divorce and live separately or you want him to get punished and put him behind bars for his attrocity or you want to make him sane and again want to restore the happy married life....what are your doubts,try to be farnk and clear before doing anything.
Re: Divorce
(1) You do not need to wear the 'thali' at all; it is not required in law; removal of thali is thus no offence;
(2) If you find that he sleeps with other women, that amounts to "cruelty" and "domestic violence" and you may initiate criminal proceedings against him;
(3) You may seek adequate compensation / maintenance for your living as per 'his financial standards' without applying for divorce. Refusing to sleep with him or permitting him to touch you is no offence; in fact in the given situation, you may refuse him entry in the house if you find his affairs with other women repulsive.

Re: Divorce
not wearing mangalsutra is not a crime,
however if your husband is having sexual affairs with other woman, you can seek appropriate remedy i.e. divorce, judicial separation , or maintenance etc.
