Legal Question in Family Law in India

divorce from schezophrenic husband

I am a hindu, was married to a man with schezophrenia...now its impossible to live with him. He does not work at all. He lives with his mom who has two houses of her own. One she rents off for our monthly expenses and other one we three are living presently. Can I take divorce on his mental illness and no working ground. Can I claim right on my MIL's property. She did not inherit this property. Can I claim maintanence from him inspite of knowing he does not work...he has his shop with has hardly any income. Please advise.

Mental illness is a ground for divorce but 'not working'.

You may not be able to claim property of your MIL.

Yes, you may claim maintenance.

You may consider a case of cheating against your MIL if it can be established that she knew his illness before marriage.
