Sir,

I married on 21st Nov. 02. 3 yrs. I lived with my husbund but at last I take this decision & from 26th Feb. 06 I leave my husbund's house. My Divorce case is filed in Bandra Court before 7 months back. I am ready to take divorce without any claim but my husbund refuse it because in Feb,06 I was filed 498 on him because I am working women & my mother in laws & my husbund always demanding money. Around 60,000/- cash I am given but I don't have any proof. I got my other things like T.V. Computer, Fridge etc. by Court. My husbund forced me to take Back this case otherwise he will not give me divorce. And I am told him that first you give me at least 50,000/- which you are taken from me than only I will take back 498 Case.

But now I am very confused that Am I right because his nature is aggressive. Can he harm me?

2nd thing my age is now 32 my parents are like to go my second marriage so will this case take time? Should I get divorce Early? Should I get money back early? (Because My husbund is working in pvt. firm & he said in court that he is not capable to give money & he is not taken money from me. So, Councellers also try to convinece me that take divorce without any claim as per your age.) Please help

As per the limited facts of your case and brief naration by you , You may think of time factor as regards getting the final legal recourse. After sorting out certain issues with your husband, if things look fair then in that case you may consider to seek smooth recourse as available, for your further positive progress than litigating in the court. Hope this should suffice your query in brief.

I advise that fight for your right and do what you think is right.your husband is adopting unfair means to compell you for mutual divorce and he is showing his aggression to terrorise you.
