can a divorce spouse take a minor out of india without other spouse consent or permission. can visa can be issued to minor child without the consent of either of spouse. where custody case are filed in delhi. advise advocate and fees.

the other spouse cannot take the minor out of india without express permission of the other spouse. the aggrieved spouse can approach the court and seek restraint orders against the spouse from taking away the minor out of jurisdiction of india.

Depending upon the country, the visa authorities may usually ask for consent for both the parents while considering visa for a minor.

If you want to take the child out of India you may file custody csae and if you granted custody you shall be entitled to do so. Apart from that the consent of both the spouses is indespensable for the moving the ward out of India.

You may request the court to expedite the matter of custody of ward in the interest of child.
