You can seek divorce on the ground on desertion and period provided to file the suit before the appropriate jurisdictional court i.e., it can be filed - in the place of marriage or at the place both last resided, is done after 7 years from the date of your husband leaving you.

You have to declare that his whereabouts are not traced and declare him dead. For more details contact with facts. No charges.

Re: divorce

You are entitled to file a case for divorce on the ground of desertion in the court of territorial jurisdiction where :

(a) the marriage took place;OR

(b) you resided last with your husband; OR

(c) where your husband is living;

since you are not do not the whereabouts of your husband, you may file a case at either of the two places (a) or (b).

the grounds for divorce will depend upon facts of your case.

however, if you can afford, you may wait for one more year and thereafter seek a declaration about 'civil death' of your husband if he has actually disappeared from the world without anyone knowing his whereabouts.

for more informed opinion, please provide full facts about your marriage. No charges.
