Hi, I want to divorce from my wife. I live in delhi (India) and work in private firm and my wife is housewife. We get married in March 2005. My wife never interested in stay with my parents, because she can not live without her mother so every month she goes to her parents. We have a baby (girl) one year and 5 months. She lived her parents after my baby born around 8 months without me. So I can not see my baby. She wants to emotional black mail to me. When my baby in 9months then she tell me she came back in one condition if she lives only with me and not with my parents. Then we separate with my parents and take a home on rent basis but now we live together from 9 months. Now she wants to live near her parents house on rent house but I can not stay away from my parents. Now I understand her and her parents planning, they want I live away from my parents. I have no brother and my three sisters already married. Now she tell me that she is going to nearest house of her parents otherwise I came or not. She also tell me that she will not give me divorce and she will live separate with me and also she will suit against me for claim of compensation of her and my baby. Please advice to me what can I do.

You should better try to reach an amicable settlement with your wife; she is entitled to maintenance for herself as well as the child. at this stage litigation is not advised.

you wife can claim maintainence for herself and child. try to take help of elders and well wishers to counsel her . better if you resolve this dispute amicablly . otherwise you have to decide whether you want a divorce and file for the same

She can claim maintainance for herself and baby.Try to resolve the dispute by counselling through friends and well wishers and try to convince her.But if you are of the firm opinion that there is no such possibility,then go for divorce wherein you can also claim custody of minor.Go by planned strategy.In case of need,you may contact me with all details.
