divorce

i and wife are married since 27 years . recently we filed an divorce application under sec 13b,where it is stated that i and my wife are living seperately since 8 years. we have registered our first concent and court has given time for six months but now i want to take the application back so can i do it only on my behalf or i need her concent also.

you can take it back yourself or even u can abandon the petition.

you are file an application seeking to withdraw YOUR CONSENT. the divorce petition will be dismissed for lack of consent of both. any one partycan withdraw consent. the very provision is for a MUTUAL CONSENT DIVORCE and not for MUTUAL WITHDRAWAL. you do not SEEK PERMISSION OF YOUR WIFE TO WITHDRAW CONSENT.

In such circumstance donot give your consent or sign second motion which shall take place after six months of first motion.
