I am a divorcee and was separated by mutual consent through order of court. I have a custody of my minor two year old child. Now I wish to change the name of my child from her parental surname to my maiden surname. I also intend to go abroad and wish to take passport in the name of my said minor child. But I am in a big trouble as to how do I change the surname of my said minor child. At passport office the officers are asking for a consent affidavit of the biological father and he may not give the consent for the same. Please suggest me as to which forum I need to approach and how do i change the surname of my said child? Please help me.

you may seek consent of the child's father.
Is there any thing with regard to the Surname etc. in the order of Mutual consent divorce? If not then you are left with no option but to request the biological father of your son to give an affidavit or consent the same to change your son's surname.
only way is to get consent from biological father and ask him for his affidavit if he consents.
