Legal Question in Family Law in India

I am a divorcee of 35 years and belongs to jainism.I have a 12 year's old son.I want to change thwe surname 'JAIN ' of my son which is his father's surname. I want to use my surname' KHATOR' with my son.can I do this? should I go to court? pl tell the process.

prepare an affidavit with change of name. get it attested from Sub Division Magistrate. with the copy of affidavit, go to newspaper and get a public notice published. Some states require gazette notification after that.
