Divorcing

Hi,

when Divorcing will be go on between foreigner girl and indian boy. what kind of rights and duties that both of them have to do and how is procedure.

We got married on February 2008 in Assam (she came here through tourist visa)

well, if Hindu Marriage Act is applicable to you, and she is not interested in alimony, you may file a petition for annulment of marriage before the District Judge of your area on the grounds mentioned in Hindu Marriage Act.

If you both want divorce then you have to move a mutual divorce application and the same will take place atleast 6 months. but if she wants to move back early even then it could be done as per supreme court authority but it depends upon your lawyer and the judge dealing your case.
