Divorse

I got married in India. But now me and my husband all set for separation.

I want to know if we can be declare as single in USA as per US law.

if you are livivng in USA for more than Past six Months, you can ask for divorce,

also contact a local lawyer

You may seek divorce by mutual consent from the local county courts in USA.

As per Indian Marriage act the person who married in India should also seek divorce in India and vice versa.You are not bound to say you are single merely you went there alone and stay there alone.You kindly check the immigration form or Visa form where in which there is a column asking you if you are single or married.So you are supposed to write that you are married and cannot deny the fact just because you are staying separately.Nevertheless you can apply for a divorce in the Indian courts where the jurisdiction falls after staying parted for more than one year.
