documents required for filing petition for divorce

I got married 2 years back under special marriage act, we are not taken any photos at that time and we don't have any other record except marriage certificate given by marriage officer, in that there is no information about bride & bridegroom address and there is no photo. 1)is it necessary to produce photos for any dispute in future, is marriage certificate is enough for us. 2)how will court identify the bride & bridegroom are the same. 3) can i ask marriage officer to give us a certificate with photo & address.

The marriage certificate given the registration officer is enough and there is no need for further details. The details furnished at the time of marriage will contain the father's name, address etc.

The identity of the contracting parties are essential, and if the same is not there then the court will rely upon circumstantial evidence, like the statement of Witnesses who have witnessed the marriage and other incidental circumstances.

1. The Marriage Certificate itself is enough, but if the court asks you have to produce the photos.

2. In a Joint Mutual petition, the court will usually ask the question as to what is the proof, for having married. You have to produce all the documents produced before the marriage officer, and produce it before the court as documentary evidence.

YOu can apply for the certificate with photo, whether the marriage officer will give or not depends if he has computer facility and an extract can be given or not also depends, but if the certificate shows your name alongwith your wife name and shows the names of your parents, that is quite sufficient.

In addition both of you have to produce your relvant documents of S.S.L.C. MARKS CARD FOR your age proof and ration card as your name will be depicted in the said documents.

the address of witnesses will be there in the Certificate and if it is not there then you can apply for and obtain the same.
