Domestic violence act

1. husband wife living separately since 20.01.06.

2. Divorce petition filed bu husband on 27.01.06.

3. FIR u/s 498-A, 4 D.P. Act lodged by wife on 27.04.06.

4. Second improved FIR lodged by wife at another place on 28.06.06.

5.Wife claiming 1/3rd salary as manitenanace amount.

6. trail at both places in FIRs pending.

7.Wife now filed case under DV Act.

------Can she claim residence (No shared residence exists)?

------Can she claim further maintenanace amount in addittion to sec 125 CrPC & sec. 24 HMA?

Yes, she is entitled to claim maintenance, residence and damages under DVA.
