Legal Question in Family Law in India

Domestic Violence Act

Sir,

I had filed a petition under Domestic Violence Act 2005 against my husband and my in-laws.My husband did not answered to any of my allegations instead straight away went for a compromise with me.In compromise i asked for a part of land for my son who is a minor and other monetary reliefs for my children. And he asked that my in-laws will live with us ,he urged that nothing untoward will happen in future.I had asked that at no point of time me or my children will be forced to live in sallagarh, palwal.I was ordered to go to sec-46 where we were residing (rented place)at that time.

On going back my husband and my in-laws repeated the same behaviour rather more than before because they were very angry with the fact that their bahu had gone to the court. My husband said that he will not adhere to the terms and conditions and constantly threatened me to make the compromise null and void.I was forced to leave the house. Now i had filed a case for contempt of court against my husband and in-laws.I want my husband to fulfill all the terms and conditions but do not want to live with him.

I want to know if this compromise can still be executed while i do not want to live with him?

Re: Domestic Violence Act

Yes, not only the compromise can be executed, but you may also consider reviving your case under DVA against your husband and in-laws.
