Legal Question in Family Law in India
my dv case is in district court.i am seeking maintenancce, compensation, streedhan etc.
i joined a well known public school of delhi just 5 days back as a teacher on contractual basis.my salary in hand is 14,000 monthly which is NOT THE GOVT SCALE.they make teachers permanent only after 5 years,ie.i can lose my job anytime within these 5 yrs.if they dont like me.
let me also tell you that my case is in court since last year.and my maintenance has not even started,ie no interim and lifelong maintenance.and during this 1 year i was jobless.
in the above scenario can the MM deny me maintenance since i m working even though this job is NOT PERMANENT,very recent & not giving me full scale .
what if i am denied maintenance since i m working and also not retained in job.then i shall be on roads.will it not be injustice?please advise me.

it is strange that your maintenance application for grant of interim maintenance has not been decided as yet. even if you are working, you still entitled for maintenance as your husband is duty bound to maintain you as per his living standard. you are also entitled for residence orders in the shared household. you may ask you lawyer to expedite your application for interim maintenance and pray for earlier disposal of the same. is there any child involved?
You are entitled to claim maintenance as per "standard of living" of your husband at the time of separation.
