DVC Mainteance Clarification1

Thanks to all giving clarifications.

She already mentioned in DVA Petion note am a working womean and earning this much of amount.

so why i need to proof again whether she working or not?. is it requred to proof please let meknow?

At the same she mentioned in that note like: ''i(my wife) have a 28yr old and substantial period of matrimonial life left over for which the respondents should bear full responsibility and unless this court grants a compensation 25lacks towards the loss and suffering due to the mental agony and the deceitful and fraudulent attitude exhibited by the respondents.''

is it correct way to mentioned in the dva case. Please let me know how i can respondent above issue.

If she has already mentioned then no proof is required from you. She will have to prove the rest.

You may consider making efforts for an out of court settlement with your wife on all family disputes; the litigation should be avoided; it will be very costly and time consuming; and the results are uncertain.

if she has already admitted that she is working and her amount of salary, no need to lead evidence in that regard. as far as compensation is concerned, the court would grant the same only when it is proved that it is you who is at fault and the reason of matrimonial discord. you may file an appropriate reply to defend yourself.
