Legal Question in Family Law in India

Hello, I have faced in-human tortured in the hands of my husband and in-laws and now I am forced to stay separately. I have lodged DV against them. But I come to know that my husband has advertised (I have 50% proof) himself for second marriage as living separately, which is fully illegal.

1) I want to know what steps I can take against such illegal act.

2) Can I get the full details of his advt. through RTI? If so, then tell me the procedure kindly.

Thanks.

you cannot do anything for the advertisement but in case you husband gets married, you may prosecute him for bigamy.

as advised earlier, you can only prosecute for bigamy and the second marriage is null and void.

What is 50% proof is not clear. Unless you have seen the advertisement, no opinion can be formed. RTI does not apply to private companies or institutions. You may check the ad on the internet. Try searching it on search engines. You may be lucky to see it.

As suggested by Mr Gupta, if he gets marry without divorce from you, he can be prosecuted for Bigamy, a criminal offence

if he tries to remarry without divorce you can file a case of bigamy but at this stage nothing can be done.
