Legal Question in Family Law in India

I am facin ig 125 crpc. my salary has been slashed from the very month of the demand and the expenses according to the current salary are so high it's not possible to spare a single rupee. besides, my wife has intentionally not been doing job. she has my daughter too! and she is better qualifed than i am. so does this help in any way? if i lose a job, do i have to still give maintenance?

i have been making some investments in insurance. if i continue to do so, will it reflect my income as high? kindly ADVISE FOR ALL ABOVE QUERIES. i am much too confused, because my lawyer is not guiding properly.

You have to maintain your wife and daughter if your are normal man earning salary, it will be proper to disclose the correct salary and actual expenses to the court so that the amount of maintance can be reduced as per the cash in hand available with you after all deductions. if she is not working than also you have to maintain her, you have to show your monthly salary only to the court what you are earning.

in case your wife is capable of earning but she is not earning, the court may take an adverse view upon her application for maintenance but as far as your daughter is concerned, in these circumstances, you are bound to maintain her even if mother intentionally not working.
