Legal Question in Family Law in India
i am facing 125 maintenance case against my wife. she has demanded 50% of my salary. I have changed job, and now have income more than earlier. what factors does court take in to considerations, my expense, investment, dependance of my old parents on me etc? our child is with her, a girl child ged 4.5 yrs. How best to defend myself? she has left me with no just cause. we have tired a no. of times to ask her to return, but to no avail.

as she is also having a child, you may have to pay for her maintenance as well. you also ned to maintain your old parents as you are equally liable towards your parents, your wife and your daughter. the court will decide the maintenance relying upon your liabilities and income.
