Legal Question in Family Law in India

Family law, divorce

Dear Sir,

It has been 2 years to my marriage. I have one child (boy). My wife is a govt. servant and me too but in different departments. After the born of my child my wife started bothering me and my family mother and father alleging that you and your family bothered me. Now since last one year she is living with her father and family and do not want to come back. We tried so many times to take her back but neither she is interested in taling nor her father. We said to her if she do not want to live with me take her all your things which she take with her like dowry and give me divorce. But she said neither she will live with me nor she will divorce me. Please help me in that condition what should i do?

Thanks,

ABC

Re: Family law, divorce

You need to keep cool and make efforts for bringing her back.

(a) You may visit her and stay with her in her parents house a few times.

(b) You have a duty to find out what went wrong in the relationship; somewhere in the process you have injured her feelings. you should try to find out that 'injury' or 'hurt' and make sincere efforts to repair that.

(c) you should also keep sending her and the child gifts on different occasions.

(d) since she is annoyed, at this stage, instead of talking of bringing her back, it may be better to give her space, keep visiting her there for meeting her and the child; when ever you visit, it may be better for you to take flowers/gifts and make efforts to make her happy. Do not forget that she is entitled for child support.

You may need to remember that there is now a dent in the relationship and you owe a duty to repair that dent. She is your wife with your child. It may be better to swallow the 'ego' in the interest of your family / married life. If you are trying to please your parents by declaring that you 'do not care' for her, you may spoil your family life.

Litigation may be costly and time consuming. If situation goes out of control, and she decides to file a criminal complaint, you may be arrested and may suffer a jail term; it may spoil your life.
