My husband beating me more and

my monther-in-law using bad words

and encouraging my husband to beat and not giving food also when i go to their house we have two houses actually my husband and my self leave in city my mother in law lives near by village. Due to fight my husband not comming to me and not giving any money to me and my child 1 year 2 moths son. Asking me to come to village but i have fear they may beat more and force to sucide hence i am not going. Is their any law that they can force me to go thier place. Or I can claim for maintenance and to live wher I was present living now the same house also my husbands.How to claim maintenace and complaint against him. Hindu hyderabad family.

Hello.

Firstly I would advise you to file a complaint u/s 489 of the Dowry Prohibition Act and file a divorce application with maintenance.

(1) It is a shame on your husband and him mom;

(2) There is no law which may force you to live at any place without your consent / free will.

(3) You are entitled to claim maintenance for living in the place where you presently living if you will wish to stay there;

(4) You may also seek a court order restraining your husband from entering the place or indulging in any kind of beating / violence etc.

(5) You may send a written complaint to the Police Commissioner of Hyderabad demanding action against him and his mom under Section 498-A IPC read with the Protection of Women from Domestic Violence Act.
