My husband beating me from 9 months. I complained in police also

they called and warned him but i was not booked the case under 498 A. Domestic Voilence case. But from one month he is not giving any money for me and my 1 year 2 months son. And also not coming to home he is with his paretns in village. My mother helping me. Now he is started telling that i am mental so he is beating me, And he is not interested to continue with me as a life partner. In this situation whether i have to approach Womens police station located at hyderabad, lal Bahadur statdium. Or i have to wait till he send divorce letter for claming maintenance and my son's part in the fathers properity and my dowry and my part in husbands properity.

Pl. advise me how to approach or have to wait.

You may register a police case under sections 406/420 and 498-A IPC and claim your dowry articles immediately; You are entitled to maintenance without waiting for his divorce petition. You may claim maintenance and damages under D.V.A. as also under the H.A.M.A.

You can lodge a complaint u/s 156(3) Cr.P.C before the magistrate or you can claim maintenanceU/S 125Cr.P.C orin domestic violance act
