Legal Question in Family Law in India

Family law india

we married 2 years back Relationships between wife and me are not coordial the main reason is she does not like my parents. we are living seperately in govt accn. she says that if my parents will come even for few days at our home she will leave for her house. she is instigated and supported by her parents in all this.she always speaks ill about my parents and sister , keeps on threatening me with false dowry case etc and maligns my parents image everytime and says she will put them in jail . she does not like even if i speak to them asking about their health and picks up a fight. she is supported in all this by her parents who have fed her with all sorts of falsehood about us to her. i am really fed up. all my efforts to reconcile have failed. pl advice what to do. can i go for divorce on grounds of mental cruelty?

The facts given by you do not make out a case of cruelty against your wife. The main reason of your dispute is your wife's disliking for your parents NOT for you.

Your married life is too young to pick up fights on issues like this; instead of thinking on divorce lines, you better think of solving these disputes amicably and try to reach an out of court settlement.

My advice to you is to solve this matter amicably with your wife.

If still it doesnt work, just write a letter (registered letter and keep the receipt) to SHO in the local police station stating all the facts. Also mention in the letter the fact that she is threatning you and your family members for dowry. Also mention that she threatns to commit suicide if I ever meet/talk to my parents.

Also state that if anything happens to her, you will not be responsible for the same. This will help in near future, even in your divorce case (in case there is a need to file it).
