Legal Question in Family Law in India
this is family partition property case, my uncle is filed a caveat petition against my grandfather property. In this case my mother and 2sisters from mother side. my mother is sent the legal notice to my uncle regarding partition of grandfather property(grandfather expried already) then my uncle filed caveat petition. my doubt is whether my mother can filed the caveat petition against my grandfather property or else can my mother file a suit in court for further proceeding without issue caveat petition to my uncle. Is caveat petition is mandatory for both side or any one side?...

in case your uncle filed the caveat, you need to send the copy of petition before filing your case. one side caveat serves the purpose.
in case your uncle filed the caveat, you need to send the copy of petition before filing your case. one side caveat serves the purpose. however, you may also file a caveat, in case he files a petition so he would be sending the notice in advance.
