family pension

i got a reply regarding a question relating to family pension benificiary i got the reply as below

However, family pension cannot be given to any other person except the wife and children. Therefore, you should immediately bring this fact to the notice of your husband's employer.

the person has retired recently from government and i brought the fact to the higher officials but there is no response i want to approach court, so under what section i should file a case.

you should approach the High Court under Articles 226 and 227 of the Constitution of India.
