Legal Question in Family Law in India
Hi, My father-in-law is 66 yrs old and is a heart patient who has undergone bypass in 2010. He is retired from a public sector bank.
He is guilty of not sharing even bare minimum information of his financial assets to anyone in the family, including his wife. To the extent that she is not aware of his Bank Account Number/s or investment details. He also does not give her cash to run the house in a fair and healthy manner. She now fears that she will be unable to access his funds and assets if he were to expire before her. She is therefore emotionally tourtured and dependent on him in all ways. He threatens to harm himself if she comes to visit her younger son (i.e. My husband and I).
Their elder son is staying with them at present. Since he is/was a bank employee, he put all him money into Fixed Deposits with his father's bank in joint name to benefit from a higher interest rate. My Father-in-law however did not share the correct documentation of these FDs with his sone and sometime in 2009-10, without my brother-in-laws knowledge, has broken all the FDs. He now claims that the money has been lost in some bad investments that he (the father) made. This is a total of some 15-16lacs.
He has also wilfully bounced 3 cheques in succession that he issued on behalf of my brother-in-law to a construction company which has led the company to demand an additional 4.5Lacs as interest to hand over his booked property. This too is not possible since he is not being given his rightful money back by my father-in-law.
Please advise whether there is any recourse available to the Brother-in-Law or mother to get some stability in life.
Thanks & regards,
