Legal Question in Family Law in India
one of my female friend wants to divorce her husband and marry another guy.She was forcibly married off to a much older divorcee against her wishes.She never had any compatibility with her husband.Her husband is not willing to give her divorce at any cost and forces her to stay with him in his house though they don't have any marital relations for the past 5 years or so.He also threatens to get her friend arrested on adultery charges.She meets and talk to her friend frequently though shes has never had any physical relations with him.Also her parents are against her getting divorced.so how can she take divorce and also not put her friend into any trouble.she has a7 year old daughter and both she and her husband are us citizens of indian origin though marriage was solemenized in india???

I would not suggest your friend to file Divorce petition in USA as the Husband is not willing to Divorce her and would challenge the jurisdiction of USA courts.The best course for your friend would be to file a contesting petition in India and get the Decree of Divorce from Indian court. She can also get the custody of her her daughter from Indian Courts.
