Section 498-A applies to cases where the husband has committed "cruelty" upon the wife.
If a complaint is made by the wife within seven years of marriage, it is presumed that the husband is guilty unless proved otherwise.
However, wife's right to lodge a complaint against the husband is not extinguished after 7 years. she can still file a complaint with the police and if the police does not take action, she can approach the court.
for detailed and more appropriate opinion, you may write with full facts of the cruelty committed upon you by your husband. No charges.
